This book analyzes the implementation of CSR reporting and codes of business conduct and ethics in the legal systems of the USA, Austria and China and their enforcement in international supply chain arbitrations. The book demonstrates that long-term profit maximization is increasingly intertwined with corporate ethics and CSR policies. In order to prevent window-dressing and greenwashing, certain control mechanisms and legal standards are required along the entire supply chain. This book introduces an ethics and CSR system recommending a reward-based whistleblowing (...) mechanism, internal oversight by a CSR and Ethics Committee comprised of independent board members and at least one sustainability expert, and an external, independent and comprehensive assurance of CSR reports provided by auditing firms or newly formed governmental agencies consisting of certified CSR experts. The author emphasizes the significance for supply chain leaders to ensure contractual enforcement of their codes of business ethics and conduct along the supply chain. Against this background, the author created a comprehensive fictitious case scenario covering a supply chain dispute arising from the breach of the supply chain leader’s code of business conduct and ethics by a lower-tier supply chain member. The author acknowledges the fact that in most of the cases the governing law of international supply chain contracts is English law or law based on English law. Thus, the author discusses potential contractual claims for damages arising from a loss of profits caused by a loss of reputation resulting from violations of core provisions of the chain leader’s supplier code of conduct pursuant to English law. As international supply chain disputes usually involve more than two parties, and international arbitration is the ideal means for the resolution of these disputes, the book compares the arbitration rules for consolidations and joinders of some of the most significant international arbitration institutions: SIAC, ICC, AIAC, ICDR, VIAC, CIETAC and HKIAC. The book is directed at legal practitioners, legislators of various jurisdictions, board members of corporations, ethics and compliance officers, academics, researchers and students. It is the author’s main goal that the book serves as an inspirational source for the establishment or the improvement of a corporate ethics and CSR system preventing window-dressing and greenwashing and covering the entire supply chain. Understanding why individuals opt out of living donation is crucial to enhancing protections for all living donors and to identify modifiable barriers to donation. We developed an ethical approach to conducting research on individuals who opted out of living kidney donation and applied it in a small-scale qualitative study at one US transplant centre. The seven study participants had varied reasons for opting out, the most prominent of which was concern about the financial burden from lost wages during the postoperative (...) period. Several reported feeling alone during their decision-making process. Although no participants used an alibi, a centre-provided statement of non-eligibility to donate, all believed that centres should offer alibis to help preserve donor autonomy. Given the complexity of participants' decisions and the emotions they experienced before and after deciding not to donate, we suggest approaches for independent living donor advocates to support this population. This study demonstrates that research on individuals who opt out of donation is feasible and yields valuable insight into methods to improve the evaluation experience for potential living donors. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Husserl has undoubtedly considered himself being influenced by Brentano, but his conflicts with the orthodox core of the School of Brentano raise the question whether his adherence to Brentano suffices to adequately grasp the context of his early philosophy. I investigate the biographical details of Husserl’s studies in Vienna to uncover hitherto unknown ties between Husserl and Austrian philosophers outside the School of Brentano. Already during his secondary school studies in the Austro-Hungarian Monarchy Husserl was exposed to the philosophy textbooks (...) of Gustav Adolf Lindner; and archival records of the University of Vienna show that he had extensively attended philosophy courses held by other philosophers, especially by Robert Zimmermann. Both Lindner and Zimmermann proposed Herbartian philosophies, and what makes Zimmermann especially interesting is that he had once been a close personal disciple of Bernard Bolzano. I use an unpublished lecture transcript, written by a fellow student of Husserl, to investigate the controversial issue of Zimmermann’s possible transmission of Bolzano’s ideas. While a direct transmission seems improbable, my investigation uncovers a plethora of Herbartian influences, which are interesting on their own terms and have not only furnished Husserl with important parts of his descriptive psychological toolbox but have also helped him navigate the Brentano-School’s debate on intentionality. With Eichmann in Jerusalem, we have, I would admit, a most unlikely case study for use in a business ethics classroom. The story of Eichmann is already some sixty years old, and his activities in his career as a Nazi were far beyond the pale of even the most egregious cases found in the typical business ethics case books. No doubt, there is some truth to the fact that introducing Eichmann’s story into an applied ethics class would inevitably depict an (...) unseemly analogy between the practices of latter day corporations and the bureaucracy of the Nazi era. My argument here, though, is that the story of Adolf Eichmann, as depicted in Hannah Arendt’s well-known Eichmann in Jerusalem, offers a philosophically cogent account of judgment and ethical decision-making that future business managers and employees would do well to heed. Indeed, Eichmann in Jerusalem, originally a series of press accounts for New Yorker magazine, deserves consideration alongside the Aristotle’s Nichomachean Ethics, Kant’s Groundwork for the Metaphysics of Morals, and other classic ethics texts in a business ethics syllabus. This is not to say that Arendt’s work is uncontroversial; there are serious questions to be raised about both her depiction of Eichmann and her conclusions about “the banality of evil.” Nevertheless, her account of ethics, which, with its account of ethical duties and its case study of Eichmann’s character, shows both its Aristotelian and Kantian influences, is a warning to readers who would conflate morality with state laws and their duties with the needs of superiors. In short, I argue that, despite her well-known critique of modern large scale economies and her general avoidance of discussions of post-industrial corporations, Arendt may be a business ethicist of the first order. Their alternative to the usual narrative of Bonhoeffer’s life holds that early in his career, long before the crisis of the Confessing Church and the rise of Nazism, Bonhoeffer made a commitment to [End Page 205] Christian pacifism that endured even through the war years and his resistance to Hitler.To argue for this alternative telling, the authors analyze Bonhoeffer’s three main “ethical” texts: the early “Barcelona lectures,” Discipleship, and finally Ethics. On their telling, while the early ethics lectures were theologically deficient, by the time that Bonhoeffer wrote Discipleship he had developed “integration,” which was “the primary theological catalyst for the ethical transition from Barcelona to Discipleship” (129). Discipleship is, they conclude, the pinnacle of Bonhoeffer’s thought, and anything that comes after it, including Ethics, cannot in any fundamental way differ from it.Alongside this diachronic analysis of Bonhoeffer’s main ethics texts, the authors emphasize two letters that Bonhoeffer wrote in 1935 and 1936. In the first, Bonhoeffer asserts that, because of his theology, he is “sometimes perceived as fanatical” (223). The second he wrote describing his “conversion experience” in 1930, in relation to the Sermon on the Mount and “Christian pacifism.” Read singly, these letters are interesting examples of Bonhoeffer’s thought and life of faith. As the authors present the argument, though, the letters comprise a unified narrative and function as an interpretive lens by which the primary texts should be understood. They think that the “fanaticism” of the first letter refers to the faith brought about in the conversion experience described in the second. The “fanaticism” letter is important because in it he asserts that, “if he were to become more ‘reasonable,’ he would have to ‘chuck [his] entire theology’” (223).Because Bonhoeffer wrote that he would have to “chuck” his theology if he made it more “reasonable,” the authors think that the theology that emerged from the conversion experience has a foundational role in his later works. Whatever Bonhoeffer wrote in Ethics, then, simply cannot disagree with the “fanaticism” that “is most fully articulated in … Discipleship” (223). All humans have an equal basic moral status. They possess the same fundamental rights, and the comparable interests of each person should count the same in calculations that determine social policy. Neither supposed racial differences, nor skin color, sex, sexual orientation, ethnicity, intelligence, nor any other differences among humans negate their fundamental equal worth and dignity. These platitudes are virtually universally affirmed. A white supremacist racist or an admirer of Adolf Hitler who denies them is rightly regarded as beyond (...) the pale of civilized dialogue. However, a very simple line of argument developed by Peter Singer challenges our understanding of these platitudes and forces us to rethink the basis and nature of the moral equality of all humans. What I call the “Singer Problem” arises if one accepts that the morally significant cognitive capacities that are relevant to the determination of the fundamental moral status of a being vary from individual to individual by degree. The problem is to specify a moral principle determining fundamental moral status that assigns a superior status to humans compared to other animals on the basis of the superior cognitive capacities of humans but also assigns all human persons an equal fundamental moral status regardless of their differing cognitive capacities. More broadly posed, the problem is to specify moral principles that yield intuitively satisfactory implications for the treatment of human individuals and other individual animals given that cognitive capacities differ across species and individuals. A search for a resolution of the Singer problem leads to disappointing results. (shrink)

It begins by discussing the meaning of the term, moving then to its origins, paying particular attention to whether it is Charles Darwin or Herbert Spencer who is the true father of the idea. It gives an exposition of early thinking on the subject, covering Darwin and Spencer themselves and then on to Social Darwinism as found in American thought, with special emphasis on Andrew Carnegie, and Germany with special emphasis on (...) Friedrich von Bernhardi. Attention is also paid to outliers, notably the Englishman Alfred Russel Wallace, the Russian Peter Kropotkin, and the German Friedrich Nietzsche. From here we move into the twentieth century looking at Adolf Hitler - hardly a regular Social Darwinian given he did not believe in evolution - and in the Anglophone world, Julian Huxley and Edward O. In this major study, Peter Zarrow examines how textbooks published for the Chinese school system played a major role in shaping new social, cultural, and political trends, the ways in which schools conveyed traditional and 'new style' knowledge and how they sought to socialize students in a rapidly changing society in the first decades of the twentieth century. Focusing on language, morality and civics, history, and geography, Zarrow shows that textbooks were quick to reflect the changing views of Chinese (...) elites during this period. Officials and educators wanted children to understand the physical and human worlds, including the evolution of society, the institutions of the economy, and the foundations of the nation-state. Through textbooks, Chinese elites sought ways to link these abstractions to the concrete lives of children, conveying a variety of interpretations of enlightenment, citizenship, and nationalism that would shape a generation as modern citizens of a new China. I "argue" that by knowingly accepting a set of propositions which is logically inconsistent, An epistemic agent need not violate any valid epistemic rule. Those types of logically inconsistent sets which it is permissible to accept are distinguished from those which may not be accepted. The results of the discussion are applied to the lottery paradox set of propositions and the preface paradox set. I also "suggest" that it may be an epistemic virtue to accept some inconsistent sets.

The emergence of experimental philosophy was one of the most significant developments in the early modern period. However, it is often overlooked in modern scholarship, despite being associated with leading figures such as Francis Bacon, Robert Boyle, Isaac Newton, Jean Le Rond d'Alembert, David Hume and Christian Wolff. Ranging from the early Royal Society of London in the seventeenth century to the uptake of experimental philosophy in Paris and Berlin in the eighteenth, this book provides new terms of reference for (...) understanding early modern philosophy and science, and its eventual eclipse in the shadow of post-Kantian notions of empiricism and rationalism. We are thankful for the opportunity to reflect more on the difficult problem of the relationship between moral evaluations and the construct of personality disorders in response to the commentaries by Mike Martin and Louis Charland. We begin by emphasizing to readers that this important problem is complicated by the different perspectives of the various disciplines involved, especially, philosophy, psychiatry, and psychology. Incredulity, anger, and dismay are among the reactions we encountered in discussions of these issues, especially with some mental (...) health professionals. Strong reactions on either side of a disciplinary divide occasionally present barriers to a dispassionate discussion of the topic. .. (shrink)

We examined Confucian moral philosophy, primarily the Analects, to determine how Confucian ethics could help managers regulate their own behavior (self-regulation) to maintain an ethical standard of practice. We found that some Confucian virtues relevant to self-regulation are common to Western concepts of management ethics such as benevolence, righteousness, wisdom, and trustworthiness. Some are relatively unique, such as ritual propriety and filial piety. We identify seven Confucian principles and discuss how they apply to achieving ethical self-regulation in management. In addition, (...) we examined some of the unique Confucian practices to achieve self-regulation including ritual and music. We balanced the framework by exploring the potential problems in applying Confucian principles to develop ethical self-regulation including whistle blowing. Confucian moral philosophy offers an indigenous Chinese theoretical framework for developing ethical self-regulation in managers. This is relevant for managers and those who relate to managers in Confucian-oriented societies, such as China, Korea, Japan, and Singapore. We recommend further research to examine if the application of the Confucian practices outlined here actually work in regulating the ethical behavior of managers in modern organizations. (shrink)

Recently, a number of philosophers of science have claimed that much explanation in the sciences, especially in the biomedical and social sciences, is mechanistic explanation. I argue the account of mechanistic explanation provided in this tradition has not been entirely satisfactory, as it has neglected to describe in complete detail the crucial causal structure of mechanistic explanation. I show how the interventionist approach to causation, especially within a structural equations framework, provides a simple and elegant account of the causal structure (...) of mechanisms. This account explains the many useful insights of traditional accounts of mechanism, such as Carl Craver's account in his book Explaining the Brain , but also helps to correct the omissions of such accounts. One of these omissions is the failure to provide an explicit formulation of a modularity constraint that plays a significant role in mechanistic explanation. One virtue of the interventionist/structural equations framework is that it allows for a simple formulation of a modularity constraint on mechanistic explanation. I illustrate the role of this constraint in the last section of the paper, which describes the form that mechanistic explanation takes in the computational, information-processing paradigm of cognitive psychology. I explore a strand of reception history that follows Rudolf Carnap’s shift from a purely syntactical analysis of constructed languages to his conception of pure semantics. My exploration focuses on Gustav Bergmann’s and Everett Hall’s interpretation of pure semantics, their understanding of what constitutes a ’formal’ investigation of language, and their arguments concerning the relationship between expressions and their extra-linguistic referents. I argue that Bergmann and Hall strongly misread Carnap’s semantic project and, subsequently, their misunderstanding is passed down through colleagues (...) and students. (shrink)

Desire-based accounts of practical argument about incompatible ends seem limited either to advice about means or to coercive threats. This paper argues that this can be avoided if the parties to the dispute desire its resolution by means other than force more than they desire the satisfaction of any particular ends. In effect, this means they must argue as if in a position of equal power. This leads to an explanation of the apparent objectivity of moral claims and of why (...) moral reasons appear to be categorical and external. It also explains how notions such as reciprocal altruism and TIT-FOR-TAT can play a role in an evolutionary account of morality. The paper concludes with an argument to the effect that a desire-based metaethic must accept the is-ought gap and explains why there may appear to be no is-ought gap from within a given normative perspective.
